We have been going after Kyle Bristow (on the right, with Richard Spencer) for years now, and we all knew he was going to make a name for himself somehow. This comes from an excellent blog called Angry White Men that we encourage folks to check out!<\/strong><\/p>\n

During\u00a0Red Ice TV<\/em>\u2018s\u00a0end of the year livestream<\/a>, hosts Lana Lokteff and Henrik Palmgren interviewed attorney Kyle Bristow about his legal work on behalf of white supremacists.<\/span><\/p>\n

Bristow, through his Foundation for the Marketplace of Ideas (\u201cFMI\u201d) has sued universities\u00a0after they denied Richard Spencer an opportunity to speak. Last year Bristow assisted Sam Dickson in his\u00a0successful lawsuit<\/a>\u00a0against Auburn University.<\/p>\n

Bristow also represented James Edwards, a racist Tennessean talk show host, in a defamation suit against the\u00a0Detroit News<\/em>\u00a0after they published a column that called Edwards a Klan leader. The Michigan State Court of Appeals\u00a0ruled against Edwards<\/a>\u00a0in late October.<\/p>\n

But according to Bristow, last year was \u201camazing for our movement and for our people, not only here but in Europe as well.\u201d He praised the activists of Generation Identity for their\u00a0failed attempt<\/a>\u00a0to stop refugee rescue missions in the Mediterranean.<\/p>\n

He boasted that the alt-right was creating its own \u201cinstitutions\u201d like the FMI, which he dubbed \u201cour own version of the ACLU.\u201d<\/p>\n

Bristow also asserted that there would soon be an alt-right candidate elected to public office who would \u201cbe able to speak for us behind enemy lines in Congress [and] in state legislatures.\u201d It\u2019s probably no coincidence that he made this prediction just as Paul Nehlen\u2019s\u00a0white nationalist beliefs<\/a>began making headlines.<\/p>\n

The discussion veered back to the FMI, which he informed Lokteff and Palmgren is a \u201cregistered nonprofit with the IRS\u201d and has \u201ccharity status with the state of Michigan.\u201d A search of the IRS website shows that the FMI is listed as a\u00a0501(c)(3) organization<\/a>. As a 501(c)(3), the FMI is a tax-exempt organization that is eligible to receive tax-deductible charitable donations.<\/p>\n

And according to\u00a0michigan.gov<\/a>, \u201cGenerally,\u00a0any organization that has received a tax-exemption from the IRS under section 501(c)(3) of the Internal Revenue Code is a charitable organization obligated to use its assets for charitable purposes.\u201d It also notes that tax-exempt charities \u201cmust provide a public benefit.\u201d<\/p>\n

Additionally, the same website provides a\u00a0document<\/a>\u00a0listing over 8 thousand charities that are authorized to solicit donations in Michigan as of December 26, 2017.<\/p>\n

On page 199 of that document, the FMI is listed as a charity based out of Clinton Township, MI. Its expiration date is listed as July 31, 2018, meaning the FMI would have 30 days before that date to submit its Charitable Solicitation License Renewal.<\/p>\n

Moreover, the FMI is listed on the website GuideStar, a website that reports on nonprofit companies and allows individuals to make donations to them. The FMI website boasts that it is a \u201cplatinum participant\u201d \u2014 which simply\u00a0gives the FMI a way<\/a>\u00a0to \u201creport quantifiable data in support of their program achievements.\u201d<\/p>\n

According to its GuideStar profile, the FMI operates on a $10,000 budget, and its mission is to \u201ceducate the public about the freedoms guaranteed by the United States Constitution and people who and organizations which strive to usurp said freedoms.\u201d<\/p>\n

It also doesn\u2019t hide its founder\u2019s reputation as a white supremacist troll, stating that Kyle Bristow has been called \u201cone of the Alt-Right\u2019s most vicious attack dogs\u201d by the Southern Poverty Law Center (\u201cSPLC\u201d). It goes on to state:<\/p>\n

Lawyers sympathetic with Alt-Right philosophy have begun to network with Bristow and FMI; already, attorneys who are licensed to practice law in sixteen states are accepting referrals from FMI to assist with legal activism against social justice warriors.<\/p>\n

In the very near future, FMI hopes to file amicus curiae briefs with federal and state courts to promote Alt-Right philosophy and to defend the Western legal tradition\u2014including the fundamental rights which it recognizes\u2014, and to become a legal juggernaut against the enemies of our people.<\/p><\/blockquote>\n

One of the most amusing aspects of the FMI\u2019s GuideStar page is the section that describes its organizational demographics. The board and staff are listed as entirely white and male \u2014 as one would expect \u2014 but under the header \u201cStrategies to Address Diversity,\u201d it merely states \u201cWe have a diversity plan.\u201d<\/p>\n

Last year, Guidestar briefly added a feature which\u00a0flagged nonprofits<\/a>\u00a0that were listed as hate groups by the SPLC, such as the American Family Association and Richard Spencer\u2019s National Policy Institute. This decision was reversed after GuideStar employees were\u00a0inundated with threats<\/a>. The FMI is listed as a white nationalist hate group by the SPLC.<\/p>\n

Bristow bragged that, through the FMI, he has been successful in forcing universities to provide white nationalists a platform from which to spew their racist vitriol. \u201cWe have a number of federal lawsuits pending right now,\u201d he said.<\/p>\n

\u201cI am assisting a lawyer in Pennsylvania, I am suing Ohio State University, I\u2019m also suing Michigan State University with regards to how they refused to let my client, Cameron Padgett, rent a publicly available room at which he had posted a number of speakers including Richard Spencer.\u201d<\/p>\n

He also claimed to have a \u201clegal network\u201d at his disposal, with which he can refer clients to other attorneys sympathetic to the white nationalist cause. And this cause isn\u2019t just limited to ensuring hate group leaders can speak on college campuses.<\/p>\n

\u201cIt has had such an amazing impact on people too,\u201d Bristow said, \u201cbecause I mean, there have been college students who have been facing possible suspension or expulsion, or derogatory entries being placed on their student records. And we have had lawyers march in the disciplinary proceedings and basically informed them what will happen to them if they don\u2019t dismiss the cases immediately.\u201d<\/p>\n

Interestingly Bristow also brought up the ongoing litigation against The Daily Stormer and its founder Andrew Anglin brought by a Jewish real estate agent. Anglin, with the $150,000 he raised via WeSearchr, hired noted First Amendment attorney Marc Randazza. (Randazza wrote a\u00a0brief post<\/a>\u00a0at the blog Popehat about the case.)<\/p>\n

According to Bristow, he and Randazza \u201cgo back a number of years.\u201d In fact, he claimed that Randazza was one of Bristow\u2019s two sponsors on his application to practice before the U.S. Supreme Court.<\/p>\n

Bristow said that Randazza offered himself as a sponsor on the condition that Bristow would \u201cdestroy the Southern Poverty Law Center someday.\u201d Lokteff and Palmgren chuckled at this, and praised Randazza for being a left-of-center attorney committed to freedom of speech.<\/p>\n

Of course, the application requires sponsors to sign a statement that the \u201capplicant\u2019s moral and professional character and standing are good.\u201d This good moral character presumably includes stunts like \u201cstraight pride\u201d rallies and a \u201cCatch an Illegal Immigrant Day\u201d event \u2014 both of which Bristow organized or attempted to organize in college.<\/p>\n

Or perhaps it encompasses a person who considers the U.S. Constitution to be \u201cwhite man\u2019s law,\u201d as Bristow remarked during his\u00a0Red Ice<\/em>\u00a0interview. \u201cThese people think hate speech can be criminalized, they think discriminatory behavior can be criminalized, I mean it\u2019s really farcical,\u201d he complained.<\/p>\n

On the other hand, Bristow opined that the First Amendment protects hate speech \u2014 which is true \u2014 but not pornography, which he called \u201cdegeneracy\u201d and \u201csmut.\u201d For good matter he added, \u201cI mean I\u2019ve read the Constitution a number of times, I\u2019ve never seen anything in there about abortion or homosexual marriage.\u201d<\/p>\n
