Stone Mountain, GA \u2014 A Georgia prosecutor announced Friday, Oct. 6, that six Georgia State Patrol SWAT troopers \u2013 Brylend Myers, Jerry Parrish, Jonathan Salcedo, Mark Lamb, Ronaldo Kegel, and Royce Zah \u2013 will not face criminal charges in the January 31, 2023 shooting death of Manuel \u2018Tortuguita\u2019 Esteban Paez Ter\u00e1n<\/a>, a nonbinary indigenous Venezuelan climate activist, in the South River Forest near Atlanta.<\/p>\n

Stone Mountain Judicial Circuit District Attorney George R. Christian was tasked with the investigation on March 8 by the Prosecuting Attorneys\u2019 Council of Georgia, ostensibly for the purpose of conducting an independent investigation. His statement describes the shooting of Ter\u00e1n, which drew international outrage amid allegations of a cover-up, as \u201cobjectively reasonable.\u201d<\/strong> According to autopsies, Ter\u00e1n received over 57 gunshot wounds when they were killed by troopers Myers, Parrish, Salcedo, Lamb, Kegel and Zah.<\/p>\n

The Georgia Bureau of Investigation (GBI), which answers to Georgia\u2019s right-wing<\/a> Attorney General Chris Carr, has always insisted that before being killed, Ter\u00e1n shot a gun at troopers after troopers fired pepper balls into their tent. This claim that was repeated again today by Stone Mountain Judicial Circuit District Attorney George Christian, an outside prosecutor assigned to investigate Ter\u00e1n\u2019s killing, which took place in unincorporated DeKalb County. <\/p>\n

When confronted and killed by SWAT troopers, Ter\u00e1n had been sleeping in a public park, during its open hours. Police were sweeping the area in the South River Forest near Atlanta where protesters had been occupying the construction site of the unpopular<\/a> and legally<\/a> contested<\/a> proposed police urban warfare complex nicknamed \u2018Cop City\u2019 and officially named the Atlanta Public Safety Training Center. The project is being pushed by the Atlanta Police Foundation, a private nonprofit funded by mega-corporations<\/a> and seen by its opponents as a vehicle for enabling corruption in Atlanta politics.<\/p>\n

Ter\u00e1n\u2019s killing came during a time of escalation from Georgia authorities against protesters who had been occupying the forest set to be destroyed for \u2018Cop City\u2019 construction. Starting in December 2022<\/a> and during and after the incident involving Ter\u00e1n\u2019s death, tree-sitters and other protesters opposing \u2018Cop City\u2019 have been charged with Georgia state-level Domestic Terrorism<\/a> under a statute that is currently being challenged as unconstitutional<\/a>.<\/p>\n

Claims that \u2018Tortuguita\u2019 shot first have previouosly been met with suspicion, as what little primary evidence that has been released publicly seems to suggest otherwise. Atlanta Police Department (APD) body camera footage from officers near the shooting<\/a> shows that APD officers believed the state trooper was shot by friendly fire (\u201cyou fucked your own officer up.\u201d<\/strong>) In March, an independent autopsy<\/a> concluded that the climate protester was shot and killed with their hands raised while sitting in a meditation position.<\/p>\n

In April, the DeKalb County Medical examiner wrote<\/a> that in their examination of Ter\u00e1n\u2019s body, \u201cgunpowder residue is not seen on the hands.\u201d<\/strong> The GBI quickly jumped in to cast doubt on the DeKalb examiner\u2019s report, insisting that Ter\u00e1n\u2019s corpse did in fact contain the \u201cpresence of particles characteristic of gunshot primer residue\u201d<\/strong> \u2014 while admitting the kind of residue they alleged was found on the body was often present on \u201cvictims of gunshot wounds.\u201d<\/strong><\/p>\n

The GBI, which operates under the same umbrella of Georgia\u2019s Department of Public Safety as the Georgia State Patrol troopers who killed Ter\u00e1n, has worked aggressively both to excuse Ter\u00e1n\u2019s shooting and to criminalize the \u2018Stop Cop City\u2019 movement of which they were a part.<\/p>\n

The GBI, along with Georgia Attorney General Chris Carr (appointed by Governor Brian Kemp), is a key player in the historically unprecedented political repression of the \u2018Stop Cop City\u2019 movement via Goergia\u2019s court system \u2013 charging music festival attendees with Domestic Terrorism<\/a>, hitting protesters with felonies for distributing fliers<\/a>, charging bail fund legal aid workers with money laundering<\/a>, and most recently indicting 61 protesters on racketeering charges<\/a> meant for organized crime, often based solely on acts of political speech.<\/p>\n

Ter\u00e1n\u2019s family filed a lawsuit<\/a> against the Atlanta Police Department under the Georgia Open Records Act this March in a bid to uncover more documentation of the killing.<\/p>\n

Royce Zah, one of the state troopers involved in killing Ter\u00e1n, is currently being sued in federal court<\/a> by a woman who alleges he shot her in the face with a plastic bullet during May 2020 George Floyd protests in Atlanta, causing \u201cpermanent facial disfigurement.\u201d<\/strong><\/p>\n

Georgia State Patrol has refused to release the disciplinary history<\/a> of any of the 6 troopers, claiming, among other reasons, that \u201cdisclosure<\/strong>\u2026 would compromise security against sabotage or criminal or terrorist acts.\u201d<\/strong><\/p>\n

Carr\u2019s Georgia AG office is also conducting its own investigation into the shooting. His zealous role in criminalizing the \u2018Stop Cop City\u2019 movement, which has drawn condemnation<\/a> from groups like Amnesty International and the Center for Constitutional Rights, may cause some to question his agency\u2019s capacity to rule neutrally on the matter. <\/p>\n
